Welcome to Bookbrary. These Terms of Service (“Terms”) govern your access to and use of the Bookbrary website, applications, and services (together, the “Service”), operated by Bookbrary LLC (“Bookbrary,” “we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must provide accurate information and keep it current. You must be at least 13 years old to use the Service, and if you are under the age of majority in your jurisdiction, you must have permission from a parent or guardian.

2. Ideas and Generated Content

You may submit ideas, prompts, and concepts to our AI generation feature (the “Book Genie”). Bookbrary does not accept, and you should not provide, uploads of pre-existing content, manuscripts, or works you have authored elsewhere. You acknowledge and agree that any idea, concept, or prompt you submit to the Book Genie, and all content generated from it (including any resulting books, series, characters, storylines, and related material), are and shall remain the sole and exclusive property of Bookbrary LLC. To the fullest extent permitted by law, you hereby assign to Bookbrary LLC all right, title, and interest in and to such ideas and generated content. You represent that any idea or prompt you submit does not infringe the intellectual property rights of any third party.

3. The Book Genie and AI-Generated Content

Bookbrary offers AI-powered generation through the Book Genie, which creates content based on your ideas and prompts. Generated content is produced automatically and may contain inaccuracies, inconsistencies, or material you did not intend. As set out above, all content generated by the Book Genie is owned by Bookbrary LLC. You must not use the Book Genie to produce or request content that infringes any third party's copyright, trademark, or other intellectual property rights. Use of the Book Genie is also subject to our Acceptable Use Policy.

4. Acceptable Use

You agree not to misuse the Service. Prohibited conduct is described in full in our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations may result in suspension or termination of your account.

5. Intellectual Property

The Service, all content generated through the Book Genie, and the Service's original content, features, and functionality are and will remain the exclusive property of Bookbrary LLC and its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service or any generated content except as permitted by these Terms.

6. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Bookbrary disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content (including AI-generated content) will be accurate, complete, or reliable.

7. Limitation of Liability

To the maximum extent permitted by law, Bookbrary LLC and its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or loss of goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. In no event shall Bookbrary's total aggregate liability to you for all claims exceed the amount you paid to Bookbrary, if any, in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Bookbrary LLC and its owners, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Your Content, (b) your use of the Service, (c) your violation of these Terms or the Acceptable Use Policy, or (d) your violation of any third-party right, including intellectual property rights.

9. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we reasonably believe violates these Terms, the Acceptable Use Policy, or applicable law, or that otherwise harms Bookbrary or its users. You may stop using the Service and delete your account at any time.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by updating the “Last updated” date above and, where appropriate, by notice within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
